Terms of Use

1. Acceptance

By downloading or using PunchDeck ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.

2. License

PunchDeck grants you a personal, non-exclusive, non-transferable license to use the App on devices you own or control, for creating, documenting and sharing site inspection records. You may not resell, redistribute, or reverse-engineer the App.

3. Reports are records, not certifications

Reports generated by PunchDeck are records of the observations and information that you enter. They are not certifications of compliance with any building code, fire code, NFPA standard, landlord–tenant rule, insurer requirement, or other regulation.

• You are responsible for the accuracy and completeness of what you record.
• You are responsible for determining which inspection intervals, forms and disclosures apply to your trade and jurisdiction — requirements differ by state, city and client.
• Where a report requires a licensed or credentialed professional, that requirement applies to you, not to the App.

4. Your data is your responsibility

All data is stored locally on your device. PunchDeck does not provide backup, sync or recovery services. Device loss, damage, iOS failure or app deletion can permanently destroy your data. Keep your own backups — for example, by sharing report archives out of the App regularly.

5. No warranty

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. PunchDeck does not warrant that the App will be uninterrupted, error-free, or that generated reports will meet the requirements of any particular authority having jurisdiction.

6. Limitation of liability

To the maximum extent permitted by law, PunchDeck's total liability arising out of or relating to the App is limited to the amount you paid for the App. PunchDeck is not liable for indirect, incidental or consequential damages, including lost profits, lost data, business interruption, or damages arising from reliance on a generated report, even if advised of the possibility of such damages.

7. Intellectual property

The App itself, including its design, code and built-in report layouts, is owned by PunchDeck and protected by copyright law. The content you create belongs to you — your projects, photos, annotations and reports are yours.

8. Termination

These Terms end automatically if you delete the App. Sections 5 and 6 survive termination.

9. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. This does not affect any mandatory consumer rights you have under the law of your country of residence.

10. Apple

You acknowledge that these Terms are between you and PunchDeck only, and not with Apple Inc. Apple is not responsible for the App or its content. To the extent these Terms conflict with the Apple Media Services terms applicable to your App Store purchase, the Apple terms control with respect to that purchase.
